B1 in lieu of H1B non-renewable... Need help or advice

Hi,

I'm french and I would like some advices about my problem so I hope someone will be able to help me.

One year ago, I went to the embassy for a B1/B2 visa and I had a B1 in lieu of H1B instead. This visa is now expired since October 2013.

3 months ago I went to the embassy. I was asking for a B1/B2 visa again. During the interview, they asked me if I wanted to re-new this B1 in lieu of H1B visa so I said yes because I didn't know it was not possible. After few minutes working on the computer they told me I couldn't have this one anymore and gave me the form 214b and I had to apply for a L1 visa.

My company started to apply for a L1 visa for someone else, so they sent the request for all the documents we need to provide for the visa.
I would like to know if I can try again for a B1/B2 and say that I don't want to renew my previous B1 in lieu of H1B because I don't need it. I just need a B1/B2 visa for what I have to do.
And if my company need to send me there before to apply for the B1/B2 visa, do you think I will be able to enter in the US with only the ESTA or if they will send me back to France.

once you have been refused a visa , you cannot go on ESTA. You have to apply for a visa again.

Yes, you can try again for a B1/B2. If they ask you, tell them there is only business meetings for a short period and you do not need a B1 in lieu of H1b.
When you complete the form just choose B1. and take the documents from your company showing the agenda
and invitation from US company.
