Having H1b Petition Paper & Applying for Business Visa

Hi,
I am srinu..I have an H1b valid Petition(This is processed through my friend) not through the present company...I have taken an visa appoint ment on february..Here i am stuck with one problem..I am in india now..I got a job offer in another company..I shifted to another company.They are asking me for Filing Business Visa for me..I did not tell i have an H1b(still i did not get the stamping).
Now a days they are forcing me for Business Visa..My priority is for H1b stamping..(if I am not get H1b Stamping)..I am trying to gone through B1..This is my idea..
I am trying to apply for B1..Is it crime..Coule you please Guide me in this case

You must not get business visa if you are going to be doing job in USA for an employer. That is illegal.

Thanks for Reply...Again I am srinu..If I did not get my H1b Stamping..what i have to do..Presently my company is offering b1..So i will take appointment for B1(Business visa) after my H1B Reject..Will it be ok in this case...

You can very well seek B1 to visit US for the business purposes of your present employer, even though your H1B has been approved in the US and you are waiting to go for the H1B visa interview. It is not a "crime" and there is every chance you will get B1 (subject to satisfaction of all the parameters). If there is a rejection of B1 issuance, it again does not hamper your H1B visa issuance (again subject to satisfaction of all the parameters for H1B issuance). So go ahead and do the needful.
