  • B1 or L1B? 6 month project that started outside US..

    Hello all,

I'm a Swedish citizen working for a global consulting company. Our biggest client is a Swedish based car manufacturer and I've been involved in a project in Sweden that has now reached the US branch of the company. As part of this project, the client now wants me to go to the US because of my specialized knowledge and stay until the project closes in May.

My parent company is a global (not Indian) company with more than 150,000 employees world wide, but the current assignment is based out of Sweden. Basically, the contract is between the Swedish branch of my company and the Swedish branch of the client's company - only the actual work will be done in the US.

I will maintain my residence here in Sweden, I will get paid by my Swedish company (where I've been employed for the last 6 years, but most of that time has been spent consulting for the current client), and I will have a return ticket.

My assignment is based around my intricate understanding of processes and the current project. The project will continue in Sweden (and other parts of the world) after the US-part has been concluded in May.

Now for my question: Am I allowed to go to the US on a B1, or do I need to apply for a L1B? (Being a EU resident, I'm eligible for ESTA, but the project lasts for more than 90 days, hence B1 could be my alternative).

I found this quote on a website:

    4) Acceptable activities include:
    a) Employees of foreign employer coming to the U.S. to solicit sales, negotiate contracts, or take orders from established customers for work that will be performed outside the U.S.
    b) Purchasing agent to procure goods, components, or raw materials to be used in production outside the U.S.

    c) Fulfill service or sales contracts already undertaken by a foreign company.

    d) Consultations with U.S. business associates.
    e) Litigation.
    f) Attend conferences, conventions, executive seminars.
    g) Independent research not relating to sales, service, or solicitation of business.
    h) Arrange employment in U.S.
    i) Arrange investments.
