B1 in lieu of the H1B - how to apply documents

Hi all,

How to apply to B1 in lieu of the H1B in Ukraine (Kiev) or possible in Poland. I read a lot about this tipe of viza in chats but nothing on official sources.
Our employee has got open B1\B2 tipe of viza. For now we have a need him to work in US for 2-3 months. How to file documents and what risks may be?

You would apply through the usual DS-160 process applicable to B visas

B-1 in lieu of H applications are subject to extraordinary scrutiny, and it is said that some consulates just simply refuse to issue them

While the B-1 in lieu of H process doesn't require written narrative, it might help to prepare one to help the employee articulate their eligibility
