    Hi ,

    i am currently having the b1 VISA (m ENRTY, 10y -2016).
    i am applying for the H1-b 2009 cap.
    i met with one consultant who told me that he will file my H1 for 2009 with less amount.

    The idea is if my application is picked up in lottery and got the H1-B approval i need go US on b1 visa and start working there.later i need to come back India for stamping .

    but he did not tell me how much time i should stay in US on H1-b approval.

    is there risk in this procedure .

    please let me know.

    If your H-1 is approved, you do not need to go to US on a B1.
    They can mail you the approval notice and you can get an H-1b stamped at the embassy.

      when i get the H1b approval i need to goto US on B1 and start working on H1b approval.after some time the consultant will send me to canada for H1b stamping.

      is there any risk in this way ?

        Yes, there is a risk of denial in canada.
        Why don't they just mail you the approval to Delhi and you can get the stamp in Delhi. IT will be straigtforward and risk free.

          It sounds like you are planning to enter the US to WORK on a B-1 visa rather than to VISIT for business purposes of your home country employer in order to begin WORKING before October 1.

          Even if you manage to avoid detection, if it is ever discovered that you WORKED illegally, you will be in a lot of trouble. A reputable employer would not suggest questionable tactics such as this.

            No, after oct-1 only. the Diff is i need to attend the stamping in the Canada.

              Oct 1 should be outside the date on your I-94 so you would have to leave the US anyway. Why not just return to India where you have the best chance of stamping and not worry about Canada at all.
