  • B1 Denied when H1 is 221(g), Please advise

I have H1 case pending for 221(g) and My B1 has been denied under(214(b))
Can I apply again for B1?
My H1 is for prospective employer and B1 is for current company.
Can I terminate My H1 application? Is it advisable?
What is the probability that I will get B1 if I apply in near future?
    I got 221(g) for H1 in Dec 2008. 214(b) in Nov 2009.

B1 denial is based on ties to home country. You were denied as a potential immigrant. That has got nothing to do with H1b being pending. You failed to convince the VO that you have ties to home country and will return.

The chances that Vo might think that you will apply for COS in US is high in your scenario.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
