New Company applying for B1

I have started small IT Company recently. Because of client requirement I need to bring one developer from India thru B1 visa. The developer in India working for my company as a contractor thru another company. Can I apply for B1 visa for the developer? Do I need to change the developer status from contractor to employee before I apply for B1?

Please keep in mind that B1 visa is not for temporarily working in the US. H1 is more suitable for that.
