Hello,
I went to US on F1 visa. As many Indians I worked in a gas station and one fine day was charged with "liquor sale to minor"..was arrested..around the same time applied for h1b premium processing (2006) and got the petition approved. and later thru a lawyer got the case dismissed also after 2 years (2008) got it expunged (all records related to this incident were destroyed). This means that i could claim that i was never arrested for any crime.
came to india (2008 dec) for H1b stamping.
interview date -- jan 29th 2009.
Chennai consulate
dont ask me why but i admitted on the form that i was arrested.the officer double checked my finger prints but dint find any history. so he asked abt the arrest. i told him abt the arrest and that i had got it expunged.
he cancelled (cancelled without prejudice stamp) my F1 visa which had already expired and asked me to get the indictment letter and some other letter. i contacted my attorney back in US who said that these records would not be available with anybody since they were all destroyed (that is what expunge means)..
so i never applied for stamping again..stayed back and joined a company.
now my company has asked me to to US on a B1.
Need to go to Mumbai Consulate.
On the B1 online form DS160, there is a question, something like:
Was ur visa rejected, denied or application withdrawn at the point(not port) of entry..
What should I answer here -- YES or NO?
Since my H1B stamping application was back in Jan 2009 it would have expired in the system (after 12 months)..
But the chennai officer might have raised a flag against my name in the database. or could he have done this on the form only?
Even if I say "NO' they might ask me "how" did my F1 get cancelled.
I was thinking of telling them -- During my H1 B stamping I was asked for client letter which i couldnt provide and hence did not go ahead with the stamping process.During this time my F1 was stamped cancelled..
If you could suggest, i would very much appreciate.I have been called a moron many a times for the mistake I did so if u r intending to make fun of me its just a waste of ur time.
