  • Applying for B visa while having valid I140 approved

    Hi,

I am an Indian citizen currently residing in Vancouver, BC on a work visa. I am trying to apply for a b1/b2 visa to US and need help with a couple of questions as noted below:

    1) I relocated to the US is 2016 on L2 visa with my husband who came to the US on L1 visa. I then switched to H1-B in 2021 and also got my I140 approved which shows my intent to
Immigrate to the US. Can I apply for B visa now?

    2) My L visa renewal (2019) and H visa haven’t been stamped yet so there are no associated visa numbers. When filling DS160 for a visa stamping appointment, what should be my response to the last issued visa and visa number question? Should it be the last stamped visa on my passport (L from 2016)?

Appreciate any advice and direction that I can get. Thanks in advance!

You can apply for B visa, but you'll need a solid reason for the purpose of your visit & you'll need to prove that your intention is not to switch back to any other visa/status while in USA & you'll surely return once your purpose is met.

It clearly says last visa "Issued". since your L renewal & H visa wasn't issued. you can skip those & mention about your L2 visa from 2016.
