  • What to do when spouse petition is pending?

Hello everyone, I'm seeking some advice from you regarding my situation.

My spouse and I tied the knot in the USA around a year and a half ago. During our marriage, my spouse was on a 6-month tourist visa while I held a green card. Following our marriage, we submitted the 130 Form, a petition for a spouse residing in the USA. Both of us were present in the USA at the time of submission.

Although I'm on the verge of acquiring US citizenship, we're yet to receive any updates on
owespeedtest the 130's approval after 1 year and 5 months. Assuming it gets approved, what would omegle be the subsequent logical step?

If your Form I-130 petition for your spouse is approved, the next step in the process would typically be to proceed with the adjustment of status application. Here's a general outline of the typical steps:
    1. Form I-130 Approval: Once your Form I-130 is approved, you will receive a Notice of Action (Form I-797) indicating the approval.
    2. Priority Date: The Notice of Action will also include a priority date, which is the date your petition was received by USCIS. This date is important for tracking your place in the visa queue.
    3. Availability of a Visa Number: Depending on the visa category and country of chargeability, there may be a wait for an available visa number. You can track the progress of visa number availability on the Visa Bulletin published monthly by the Department of State.
    4. Submitting Form I-485: When a visa number becomes available, you can file the Form I-485, Application to Register Permanent Residence or Adjust Status. This form allows your spouse to apply for lawful permanent resident status (green card) within the United States.
    5. Biometrics and Interview: After filing the I-485, your spouse will be scheduled for biometrics (fingerprinting) and, if necessary, an interview at a USCIS office. These steps are part of the background check and evaluation process.
    6. Decision: USCIS will review the submitted documents, conduct the necessary background checks, and make a decision on the adjustment of status application. If approved, your spouse will be granted lawful permanent resident status (green card).
    7. Conditional Green Card (if applicable): If you have been married for less than two years at the time of adjustment of status approval, your spouse will receive a conditional green card, valid for two years. This card requires additional steps to remove the conditions before it expires.

It's important to note that the timeline and specific requirements may vary based on individual circumstances and changes in immigration policies. It's recommended to consult with an immigration attorney or refer to the official USCIS website for the most up-to-date and accurate information regarding your specific case.
