  • Seeking advice on B1 visa application for USA?

I'm seeking advice regarding my B1 visa application for the USA. As a professional Triathlete, I have been spending a significant amount of time in the USA for racing and training purposes. Currently, I enter the USA using the Visa Waiver Program as a British citizen, allowing me to stay for 90 days at a time.

However, I have an appointment at the London embassy for a B1 visa on Monday, but recent research has made me question if this is the best option for me. I would appreciate any advice or guidance you can provide in this matter.

My goal is to obtain a visa that allows me to stay in the USA for more than 90 days, as the B1 visa covers amateur and professional athletes participating in races with prize money.

Additionally, I would like to clarify whether a potential rejection of the B1 visa application would have any impact on my current ESTA status. I am planning to depart and would prefer to avoid any complications or issues during my travel.

Thank you for your assistance. Your insights are greatly appreciated.

I'm not an immigration lawyer, but I can provide some general information that may be helpful to you. When it comes to visa applications, it's always advisable to consult with an immigration attorney who can provide personalized advice based on your specific circumstances. Regarding your situation as a professional triathlete, the B1 visa can indeed be an appropriate option for individuals participating in races with prize money. The B1 visa allows for business-related activities, including participating in athletic competitions, as long as the individual is not receiving payment from a U.S. source other than prize money. It's important to provide supporting documentation, such as race invitations, contracts, or letters from sponsors, to demonstrate the purpose of your visit and your eligibility for the visa. However, recent research has made you question if the B1 visa is the best option for you. In this case, it's crucial to consult with an immigration attorney who can review your specific circumstances and provide tailored advice. They can assess your eligibility for other visa categories, such as the O-1 visa for individuals with extraordinary ability in athletics, and help you determine the most suitable path forward. Regarding the potential rejection of your B1 visa application, it generally does not impact your current ESTA status or participation in the Visa Waiver Program. These are separate programs, and a visa denial should not automatically affect your eligibility for the Visa Waiver Program. However, it's important to provide accurate and consistent information when applying for visas or entering the U.S. under the Visa Waiver Program to avoid any complications or potential issues. Again, it's strongly recommended to seek advice from an immigration attorney who can guide you through the visa application process and provide specific guidance based on your individual circumstances. They can help ensure that you make informed decisions and take the best course of action for your situation.
