  • Validity of B1/B2 after L1A and change of employer

    Hello,

I used to work for company A in India in 2007 when I had to represent the company for business discussions in the US - for which I had applied for and was issued a B1/B2 visa, no annotations, for 10 years validity until 2017. Between 2007 and 2008, I traveled to the US twice for purely business discussions for durations less than 2 weeks each time. Subsequently, the same company applied for an L1A visa for me using which I traveled to the US in 2008. I returned to India for good, in 2011, a couple of weeks before my L1A visa expired. Later in 2011, I quit company A and joined company B which is much smaller (almost a startup) and now intend to travel to the US to represent company B for business discussions (strictly not employment) for a period of 2 weeks. I have the following questions and any advice/guidance is greatly appreciated:

    (a) Does my B1/B2 from 2007 automatically stand cancelled upon issuance of L1A in 2008?

    (b) The B1/B2 visa sticker is NOT stamped "cancelled" or "cancelled without prejudice" - could this be oversight on part of the consulate at the time of issuing L1A?

    (c) At the time of my separation with company A (a very large global corporation) - the immigration department there requested for my "valid" B1/B2 details so that they could inform the consulate about my separation. Does this in any way imply that my B1/B2 stands cancelled, even if my passport/visa sticker do not indicate this as such?

    (d) If my B1/B2 is in fact valid, can I travel for company B now (and in future) using the same B1/B2 visa for exclusively business purposes for a period of 2 weeks?

    Thanks a lot.

    Answer found first hand...

I was hoping for advice from someone in the forum, but here are the answers to my questions - from my experience (I have in fact traveled to the US since I posted my questions here...). As always on this forum, I guess it goes without saying - this is not legal advice, an advice just based on one individual's experience

    (a) Does my B1/B2 from 2007 automatically stand cancelled upon issuance of L1A in 2008?
NO - one can have a valid B1/B2 visa at the same time as an L1 or an H1 (unless it is an B1 in lieu of H1 - in which case, the B gets automatically cancelled)

    (b) The B1/B2 visa sticker is NOT stamped "cancelled" or "cancelled without prejudice" - could this be oversight on part of the consulate at the time of issuing L1A?
    NO

    (c) At the time of my separation with company A (a very large global corporation) - the immigration department there requested for my "valid" B1/B2 details so that they could inform the consulate about my separation. Does this in any way imply that my B1/B2 stands cancelled, even if my passport/visa sticker do not indicate this as such?
NO - apparently the reason these details are communicated to the Consulate by the large corporation is to protect themselves from any fraudulent usage of the B1/B2 after the separation of the employee. Also, B1/B2 is issued to an individual NOT to an organization.

    (d) If my B1/B2 is in fact valid, can I travel for company B now (and in future) using the same B1/B2 visa for exclusively business purposes for a period of 2 weeks?
YES - until the B1/B2 is actually valid
