  • B1 VISA Rentry

    Hi,
I have couple of queries, please clarify.

I came to US on B1 VISA(BEP), and i got a I-94 for 6 months. My family will be going for VISA interview next week and will travel as soon as they get passports.

    Question

    1. Will they get VISA?
    2. This question is regarding stay, i was told by my freind that if I-94 is given for 6 months you are not supposed to stay for greater than 3 month and less than or equal to 6 months.
Since when my family comes their I-94 will be more than my tenure.
And it might be problem for me when i go back to india and come again to US after some time may be alone or with family again with same VISA type.

Is that true please help me.

    Thanks
    vibgyor

Legally you can stay till the date on your I-94 ( 6 months).

But long stays can have impact on your future entries, if the next visit is too quick.

There is no hard and fast rule about staying 3 months out of 6 .
But let us say, you stay 6 months and you need to come again 3 mnths later on a business visit,
you may face questions at entry about staying long and re-visiting too quickly.

About your wife's visa, all depends on the officer.
She should never say her stay is going to be 6 months.
She should say , she wishes to join her husband on his business trip and wish to go sightseeing for 3 weeks.

      Thank you for your reply.
One last question so you mean if i stay for 6 months now, and i should come again after may be again 6 months or 1 year then it will be good.
If i come on other visa type like L1, or H1 then also i should keep long gap .of say 6 months or more.

If you wish to stay 6 months now , but do not plan to re-enter on a B1/B2 in another 1 year, you are safe. But I suggest keep it a few weeks below 6 months.

Previous long stays on a B1/B2 ( provided it is not an overstay) will in no way impact your future entry on an L1 or an H1. Even if you enter on an H-1,L1 like a month later from your departure on a B1, you will be fine.
