  • B1 from UK

    Hi All,

I am an Indian citizen and came to UK to finish my MS. Before coming to UK, I attempted two times to go to US for doing MS and both times I had failed to get the student (F1) visa. After completing my MS, I joined with a software company in UK and working for last 1 1/2 years. Their main office is in US. They are asking me to come to US for 6 weeks to give training on their product. They are ready to process my business visa. I have following questions.

    1. Does my F1 rejection has any impact?

    2. Do I need to apply visitor visa or business visa?

    3. If business visa, can I apply from UK or do I need to apply from India

    4. List of documents submitted from employee side and employer side.

    Thanks in advance,
    Balu

    1. Does my F1 rejection has any impact?

Depends somewhat on why you were denied F1 twice.
But mostly, your current application will be seen in a new light of your
    current life situation.

    2. Do I need to apply visitor visa or business visa?

    Whether the purpose is visit or business , the visa granted is the same in both cases;
B1/B2 . Still, while completing form DS 160 you must opt for B1( business).

    3. If business visa, can I apply from UK or do I need to apply from India

Your current job ties are in UK, so you must apply in UK.
But you must be able to show that your job in UK is ongoing for a good length in future.( employer's letter)

    4. List of documents submitted from employee side and employer side.

Usually it is the employer's letter showing your employment , salary, title of job,
length of employment in the past and in future, and what you intend to do in US.
You should be able to show your income proof ( very imp.) as tax return or salary slip.

You must consult the US embassy london website for a full list of documents required.

Adv; Third country nationals usually find it difficult ( not impossible) to get B1/B2s .
And these days people going on business for more than 2-3 weeks are suspect
they will misuse the B1 visa for work. Also , employees who have only 1-2
years of experience in their job may also be denied a B1.
I think you should mention a short term assignment ( talk to your company)
of 2 weeks or so, and a strong letter from your employer how important it is
    for you to go.
If you can afford one, talk to a good immigration lawyer before applying.
