  • Concurrent filing of I-751 and N-400

According to the field office processing dates for CALIFORNIA SERVICE CENTER, as of September 30 2012, it will take up to 6 months to process I-751 (Petition to Remove the Conditions on Residence). In my case, this means USCIS will complete my I-751 application by June 22, 2013.

Since I will qualify to file N-400 (Application for Naturalization) starting September 5, 2013 (72 days later), can I concurrently file I-751 (Petition to Remove the Conditions of Residence) with N-400 applications (Application for Naturalization)?
    Please advice. Thank You!

Unfortunately, not. You would have to wait until a decision is made on your I-751 application. That signifies that the conditions on your permanent residence has been removed.

When you send in the application (form I-751), usually your status is automatically extended for a period of 1 year pending the adjudication of your case. You would receive a letter in the mail to that effect.
