Hi everyone, here's the situation :
My father was married in the US but then he separated from his wife and filed for a divorce. Few months later he left the US and got married in Morocco.
Now he's been living with his new wife in Morocco for over 18 years and they have 3 kids.
So when my father decided to pass the citizenship to his kids through the consulate, he realized that the divorce from his first marriage didn't go through and the case was still pending 19 years later ...
Now, I know that one of the requirements to naturalize your kids is that the parents should be married at the time the kids were born, which in my father's case he was married in Morocco. But since he was not divorced yet in US, would that make his second marriage void up until he finalizes the first one? if so does that mean his children can't become citizens through him?
I should specify that the divorce from the first marriage did finally go through, but it wasn't until after the birth of the 3 kids.
