Hi, hopefully someone can help me with a question i have about eligibility. My company applied for my employment based GC some time in 2005 and while the application was in process i got married in 2008 and my spouse is a USC.
My employment based GC was approved in 2010. I never did apply for a spouse based GC since the employment based GC was in process. It will soon be 3 years since i got my employment based GC and i was wondering if i could apply for a spouse based USC since the eligibility criteria for citizenship for a person married to a USC is 3 yrs. I am not sure if i actually have to wait 5 yrs to apply for an USC since my GC is actually an employment based GC even though i am married to an USC.
