  • Fingerprinting rescheduling!

    Hi
    My husband's attorney filed his citizenship papers in May, a week before we left for a month long vacation to India.
    We asked the attorney what if he got the fingerprinting appt. when we were out of the country and she said it was no issue... she would just request for it to be rescheduled.

    As luck would have it, he did get an appointment when we were in India and the attorney sent USCIS a rescheduling request. It has been nearly 2 months and we haven't got an appointment yet. Now the attorney tells us that it takes much longer to get a second appointment. We have also read that he needs to finish his fingerprinting within a specific number of days (120?) or his application will be denied.

    We are irritated with our attorney... but more importantly, don't know what to do now. My husband leaves for a week long work trip out of the country again next week and we are worried we may get the appointment at that time again.

    If his application does get denied, can we reapply??

    I would just wait for now without worrying too much about it. I would file another case *without* using a lawyer if the ongoing case was denied. If I was in your husband's position, I would not even consider using a lawyer in the first place for such a simple process. All your husband has to do is to take full responsibility for what could happen to his schedule. It things are too unpredictable, just don't file a petition until the situation changes. You know the rules so play wisely under them instead of expecting someone (a laywer) to do a miracle for you.

      Make an INFOPASS and get it done!

      My wife's father passed away right after we applied, we rushed to homeland, the house was locked and no one was picking up the mails. We came back after 25 days, and realized that we missed the FP appointment. I called NSC, they asked us to send the 'reschedule request', which we did, but did not hear back from them for over a month. Than I made an INFOPASS appointment, to our surprise, they did the Finger Printing for me and my wife then and there, and next day we were scheduled for interview. So I would not wait for your attorney and response from USCIS, just get an INFOPASS and get it done, ASAP!
