  • Baby born in India for US citizen

    Hi,

My wife is a naturalized US citizen and recently we are blessed with a baby, she is born in India. When we applied for the baby's US citizenship at the US consulate, they rejected saying that, my wife does not full fill the condition of five year physical presence in US. I am in US on Green Card. Can any body suggest me what is the best way to deal with this situation, how can i bring my baby to US...? wise suggestion is much appreciated.

Your wife is a naturalised citizen without 5 years of physical presence? Even before she became a permanent resident?

Yes....she came to US when she received her Green Card. Total stay from the day she came to US till date is 4yrs and 10 months and this is calculated by using entry and exit stamps on all the passport.
