Waiting for Oath to be scheduled since Oct 30th 2013 - Chicago

  • Waiting for Oath to be scheduled since Oct 30th 2013 - Chicago

    Hello,

    I have gone through all the hoops and made sure that I am eligible to apply for Citizenship. After the interview with the IO, she said that I will get a notification pretty soon and I did - that i will be scheduled for an oath within 45 days after the approval. And that was on October 30th 2013. I have been waiting since then. I have called USCIS numerous times
    - after 45 days - December 15th - and they asked me to wait for 90 days saying that it takes anywhere form 45-90 days.
    I called again just to make sure that I have correct information and this time - they said it will take 120 days for the scheduling.
    I called after 90 days - at the end of January and the rep said - "You have crossed the normal processing duration, let me put a service request to see whats the delay." She asked me to call back in 15 days and today I did call them back.
    Today - The rep gives me new info saying that the service request takes 30 days, and i need to wait for another 15 days.

    I have had enough of this waiting nonsense, so I called and lodged a complaint saying that this is what has been going on, and this time, I get a surprising piece of information - if the oath has not been scheduled within 45 days, we can lodge a service request/complaint and they will look into it. The information that was given to me on prior occasions were all false.

    I just want to know if anyone is in the same situation/ has experienced similar situation in regards to any field office. Not just in Chicago..

    Oath scheduling beyond 45 days is not uncommon, mainly because the USCIS office in that area is "saving" oath-takers for a large public ceremony. You may have interpreted this as a "45-day requirement," but such "requirements" are only expected or published processing times, for which a large number of cases routinely go beyond such timeframes. Your options may include a "Writ of Mandamus," to compel the agency to meet its processing timeframes, or to lodge a complaint, or to just wait until you receive an oath-taking date.

    But to sit idly and wait to be called to an interview has its risks, as many files get lost or shelved, and sometimes the only action will be if you take action to pressure the agency to find out what's wrong with your file

      I understand that time-frames are something that are beyond USCIS control. That was exactly why I requested them to give me correct information. If I had known before what I know now, I would have lodged a complaint back in December '13. Like I said, I have a service request that should get me more information by the end of this month. If not, then I plan on going ahead with your advise - Writ of Mandamus.
