Student filing N-400 where the school is, 3-month residency still required?

    Hi everyone,

    I am a student whose main residence is in Texas and I will be going to a school in North Carolina starting September 2014. I understand that, as an financially-independent student, I will have to file the N-400 to the NC state. Do you know how can I let USCIS know which state I am filing to, since TX and NC both collect N-400 from the Dallas TX box? Do I simply list my new NC address in Part 4, #1?

    Also, as a student, do I still have to comply to the 3-month residency requirement? Meaning that I will have to wait until December 2014 before I can file my N-400 in NC? Or can I file my N-400 right away? (I immigrated here in mid October 2009 so I can actually file in late July 2014 would I still lived in Texas)

    I successfully naturalized and would like to answer my own question, in case somebody will need the same information.

    Yes. I just filled out my form using the address where I go to school. It's totally fine.

    And no. As a student, I did not have to comply to the 3-month residency requirement [the one that says you have to reside in a state for at least 3 months before filing your application otherwise it will be denied as the USCIS service center might not have jurisdiction on you.] [Of course I had to meet the physical and continuous residency requirements.] I came from TX to NC in September and had my interview in November. As long as I provided the interviewer with proof of enrollment at my NC school, I was fine.

    Bottom line is that a student can naturalize where s/he goes to school without hassle. If you are a student starting college out-of-state right when when your time to naturalize comes up, do not worry. Just move to that state and file an application as soon as you arrive in the new state. As long as you have proof of college enrollment, they don't ask you to prove that you've been residing in the state for at least 3 months.
