    Quick Question: On USCIS Website, it is stated that if applicant has been denied Citizenship due to his absence of more than 1 year, he can apply after 4 year 1 day from the day he entered as a green card holder into the US after that 1 year trip.

    Now my question is that if someone has been outside for 8 months and has persuambly broken his continuous residence requirement as he was away for more than 6 months, When can he apply? Does he have to get DENIED first in order to apply after 4 year 1 day from his last admission into US or he has to wait 5 complete years from the date he got back into US after that 8 month trip, to apply for Naturalization if he hasnt been denied yet?

    It is confusing as there is no mention of applicants reeligibility to apply,who have broken their continuous residence by residing overseas for less than 1 year but more than 6 months.

    Any leads/Link/Examples will be appreciated.

    You don't need to be denied. I've heard of people applying after a break of between 6 months and a year (4 year 1 day rule), so you can go for it. However, if there's no rush, it's advisable to wait the whole 5 years, or 4 years minus 90 days.
