Many countries like USA, Australia , UK and European countries offer dual nationality. However India does not offer Dual
nationality and it offers Oversees citizen of India which is not very helpful.
Many countries allow dual nationality since it citizens travel and conduct business overseas.It will also help its citizens
who has gone abroad and took another nationality due to job requirement to come back and retire/live in the original country.
Most of the citizens from India are going abroad for Job and because of the Job requirements or job protection
they become the citizens of that country. When they become old or would like to return to India , they have to take OCI card
or take visa.
The Constitution of India usually does not permit holding Indian citizenship and citizenship of a foreign country simultaneously.
One of the reasons why the dual nationality is not offered is because of the legal issues.( Which country rule is he going to follow
and will the person do crime in one country and escape to another country ).
However above is irrelevant since most of the countries has agreements to exchange the criminals . Who ever comes and lives in India
has to obey its rules which is applicable to Indian citizens and those who come on visa.
Hence this is an important request from NRIs who live abroad to retain the Indian citizenship when they gets another country citizenship.
Wondered if you could discuss this and file a petition. Our laws are getting liberal and next time government will allow to vote online
for the NRIs.
India relaxed its steps towards dual nationality in 2005 by introducing OCI Card. I think now it is the time for India to make it not mandatory
to terminate its citizenship/nationality when one acquires another nationality.
What do you think ? Shall we file a public litigation in the supreme court ? If yes what are the benefits of retaining once nationality ? Please share your thoughts
