Well that's unfortunate. And you are correct about the fee, I was looking at the I-130 fee.

    Thanks again.

Also is it true that the DS-260 and affidavit of support are unrelated? Being able to pay for the DS-260 fee is independent from the submission of the AOS?

The DS-260 form availability follows payment of the $230 visa bill. After the $230 fee is paid, and the CMR cover sheet downloaded, the civil documents can be submitted.

The sponsorship documents submittal can be done immediately after paying the $88 fee and downloading the AOS cover page.

Hello again Ray, there has been an interesting development. I am checking ceac.state.gov everyday to see if I can pay the $230 fee, and just now I randomly decided to click on the DS-261 link. To my surprise, it was listed as incomplete. I then completed it, then submitted it.

But I checked my email archives and definitely received a confirmation email about completing the DS-261 a month ago. The confirmation number is the same on both confirmation pages, the only difference is the completion dates.

        Any idea what's going on?

        Thank you for your time,

        Simon

I've seen this happen before when someone (you or another family member) went to the "review" step of the form and reentered a signature or submit, which resulted in a new submittal date. I did it accidentally on one I was reviewing for a client, and it seemed to start a new calender countdown for the $230 visa fee payment.

Great, so I guess I just set the process back 1 month? Nice.

Well thanks for the info, guess I will just have to wait longer.

I'm not certain that you lost a month, but I believe I lost the option for paying the $230 bill for a couple of weeks.

Cheers Ray, are things still slow on your end?

Got another unrelated question. Because this whole process is taking longer than I expected, I will have to go home first, without my wife.

But can my wife go to America with me on a tourist visa, then fly back to her home country in time for the green card interview, then get her green card and come back to America? Does this make sense? Is this possible?

                Any input is well appreciated,

                Simon

                  Simon,

Once in immigrant procedure (petition) has started, "intent to immigrate" has been made and that is a reason for denial of a visitor visa or denial of entry at the arrival airport.

You're the man Ray, on point as usual. I guess we just have to wait.

I am currently checking the ceac.state.gov website everyday to see if I can pay or not. Am I going about this the right way?

I just got an email from the NVC that they received my AOS about a month ago. Will they email me to tell me that I can pay for the IV visa fee?

After I pay the fee and complete the online application, then do they mail me the pre-interview packet? Sorry for all the questions, but I have seen so much contradictory information all over the internet, but you seem to know your stuff.

Any input is well appreciated as usual, thank you for your time,

                    Simon

After the $230 visa fee is paid, you will have to submit civil documents to the NVC, then complete the DS-260.

Once the NVC has reviewed your sponsorship packet and civil documents, and is satisfied, they send an appointment packet for the Embassy interview.

Thanks again Ray, just some more follow-up questions.

When will I know when I can pay the fee? Should I just keep on visiting the website everyday? Have you been able to pay for your pending cases or are things still slow?

                        Thanks again,

You'll get a $230 bill eventually. It's just that in the last 6 months, these $230 bills have been taking up to two months to show up. In the past, the $230 bills came about a week after the "Agent address" form was completed and submitted.

                              inquiry for DS 260 form

                              Hi Ray,

I would like inquire from you regarding the DS 260 form. This is regarding the case of my stepdaughter, my question is what she will put on the DS 260 form about the full name of her mother, Is her maiden name before she got married? or Is her name after getting married?

Hoping for your kind answer on this matter. Thanks

The DS-260 does not specify whether maiden or married name needs to be inputted for mother. Go to the DS-260 sample at:

I don't think it makes any difference, though the earlier form (before DS-260) specified maiden name or mother.
