  • N-400 (#11.18) and legal firearm sale

    Hi,

I am just filling out my N-400, which has been pretty straightforward. There is just one question that is giving me headache. Maybe someone here can help or post his/her experiences.

I legally own a couple of firearms and also have a Concealed Weapons Permit (Florida). I am thinking about selling two firearms before handing in the N-400 later in the year. And that brings me to Part #11, Question 18: Did you ever sell give or provide weapons to any person?

Well, I understand the background of the question to make sure I am not an arms dealer. But what would I answer once I sell my legal firearm here in the US with a bill of sale? Sure, I can say "Yes" and attach an explanation, but what would the consequences of any "Yes" in Part 11 be? Is that a reason for denial?

    Any help is appreciated.

    Thanks, Chris

In case anybody has the same problem: I answered the question with "yes", which caused my interviewer to ask about it. I had copied the firearm's bills of sale and a written explanation in my N-400 as an addendum. I explained the legality of such sales and the question was circled on the N-400 by my interviewer and "LEGAL" written next to it. That's it. No knockout criteria, no issue.

thanks for the update, Chris! it is always interesting to hear what actually happens in an interview. In spite of it going smoothly for you, i would recommend postponing the sale (if possible) until after you get your citizenship so that there is nothing unusual about the application. Every 'yes' in that section prompts a question by the USCIS officer and can be a potential problem.

Totally agreed - keep it as clean as possible.

I would also argue, that there is a difference between one or two sales over a 3 year period and one or two per months. Although there is a case out somewhere where a guy who owned or worked at a licensed gun shop had to - truthfully - admit, that he "made weapons available" to hundreds if not thousands of third parties. But again, it came down to a proper explanation and I think he passed as well.
