  • Child born abroad but has US passport question

    a little advice if possible

I am a UK citizen, my Wife is a US citizen. We have a child (6 months old) who was born in the UK. We have filed the birth abroad at the US Embassy in London.

My daughter has received her US social security number and her US passport. We have not and are not planning on applying for a British Passport at this time.

We are planning to move to the US in the upcoming months, me on a CR1 visa, is there anything else my Daughter will need, or you could recommend for entering the US?

I am aware there are a few vaccinations we will need to get done when we arrive in the US, flu jab, varicella, which are currently not available in the UK. Other than that is there anything?

    Thanks in advance

    Simon,

For your U.S. spousal immigrant visa, you will be required to have an immigrant medical exam, with specified vaccinations, before your Embassy interview.

I am aware of this, and have completed the medical. Everything is complete for me. I am just waiting on my interview date.

I was just curious on my daughter. She has never traveled to the US before. She is 6 months old , born in the UK, but has full US citizenship through her mother.

We have her US passport, we have her US Social, would she just enter the country as a normal US citizen with my wife? Or are the any additional i can make sure are completed before be travel?

Departure of a U.S. citizen child born outside of the U.S. varies with birth country. I can't speak for the U.K., but the Philippines requires that the infant with a U.S. passport who does not also have a Philippine passport be "exit-cleared" through Philippine immigration, with a resulting exit fee (can be as much as $200).

You will have to address this question regarding your child to U.K. immigration. In theory, a child with a U.S. passport could be treated as a visa overstay and subject to an overstay penalty fee. I know it seems nonsensical, but that's what happens when in the Philippines.

          My personal experience

I am sure UK has Exit permit requirement just like other countries. I had to do that for my Son when I brought him here from India. When you got your CRBA approved, US consulate should have given a letter requesting UK immigration authority to issue you the exit permit. There will be some fees (not bribe which I had to deal with in India). Once you have that permit, she enters just like any other US citizen in US. The permit is only required to leave UK not to enter US.

There was no letter received with the CRBA. Doing a bit of googling on your basis, it does seem to be quite a common asked question regarding Indian laws, but that was the only country that came up.

I can not find any information on an exit permit for leaving the UK in this scenario.

              Just check

Just to be safe, I would call US Consulate in UK and UK Immigration authority and ask them if there is anything else that is required other than possport and CRBA. You may not need anything else afterall. Why I am telling you this is, I had that letter and thought that is the exit permit that I have to present at the airport to Indian immigration and at the airport they said I will have to got to Police commissoner's office and get permit based on this letter. They took my luggage off the plane and I had to reschedule my flight after a week once I had that letter.

I hope you don't have to go through the same.

              Thanks,
              Chirag

Just for anyone else who maybe in this situation, 95% confident there is no other exit clearance conditions from UK for a CRBA/US passport child.
