  • N-336 interview decision over 120 days-please advise

    Hello:

    I recently had a N-336 interview regarding my naturalization application. It has now been over the 120 days and no decision has been received. I would like to know what the general expert consensus is regarding further action on the application. Should I file a writ of mandamus in Federal court or apply for a new N-400? (through an attorney ofcourse). I have seen that in general, on all forums, the attorneys' opinions are divided on this next step. Please advise.

    You obviously have serious problems. What does your attorney say about this?

    Writs of Mandamus are helpful if USCIS is sitting on an application that they COULD or SHOULD approve.

    You have already failed at an N-400, so is it possible that pushing them to make a decision will result in your petition being denied?
