  • Divorce/ Marriage

    Hello,

    I need some advice please.

In 2010 I married a US citizen. We got married in the US, but never lived there.
Shortly after we got married we moved to Italy.
The plan was to live and work in Europe and occasionally visit friends and family in the US during vacations.
I never thought about applying for a green card or any type of visa to live and work permanently in the US.

In 2013 we had a fight and she went back to the US and I remained in Italy.
We tried to get back together but didn’t work. Now she is still in the US and I’m in Italy.
We are still legally married, but now I’ve found someone else I would like to marry.

Now my question. Before I get divorced what are my options to get legal residency status is the US.
I’m now thinking of moving there permanently if possible.
Should I apply for some kind of visa or green card ? Which visa or process should I go through ?
How long does it take to get everything processed ? And what would it cost ?

I know I’m asking a lot of questions. But I don’t know where to look online or who I can ask.
I understand it might also not be easy to answer, for now I just need some rough guidelines on my options.

    Thank you

    Greencard

Only your current wife can file for you so if you are no longer together I'm pretty sure she will not be willing to go through that lengthy process to get you a greencard for you to divorce her and marry someone else.
This is my opinion not legal advice.
