  • Does this affect Oathing ceremony?

    Hi,
    My brother just passed his N-400 citizenship interview. He is a cashier in a gas station. few days after interview while he was in his job, the cop sent him a girl to buy a swisher. he forgot to check her ID. So, he was cited for providing tobacco to minor. he was given a traffic ticket with Infraction under section 308 (a). It is his first time and has a clean record, even no other traffic tickets. location is California. my question is: 1. Does this affect his oath ceremony?

    He will have to explain this to the USCIS officer at the oath ceremony. If the USCIS officer can not research the issue in time for the actual oath, they will reschedule his ceremony to a month later, while they figure things out. From my reading of the USCIS policy manual, furnishing tobacco to a minor should not preclude a finding of good moral character.

      Thank you for your reply. What if I pay the penalty and show the receipt and ticket to IO? The Sheriff told him that there will be a penalty. he marked "Infraction, Traffic" box in his citation. I don't know more about this. Thank you again for your reply.

        Yes, before his Oat Ceremony, he will be asked if ANYTHING has changed since his interview. This is where he should respond, by saying, yes.

        He should take, all documents and receipts of payments along, for their viewing.

        I have no doubt, his papers will be assessed and possible a new date for Oat Ceremony may be given. Good luck to him. Next time he should be more careful. We all make mistakes.

          He disclosed his citation to the officer and asked him to send all court documents to them. the court dismissed his case and referred him to Financial hearing officer. he is waiting to receive the letter from financial officer for the payment. He also received a letter from immigration which he has been given two weeks to repond in writing about the case. but not clear that those two weeks starts from the issue date of the letter? and the letter servies as motion to reopen for naturalization. My question is: can I only send the court order which they referred me to financial officer and case dismissed or wait for financial officer to pay and then send all together? if I wait for financial officer hearing, it may take a little time and due date for immigration may pass. I don't know what to do? Thanks for your reply.

            Normally, I would have said, wait for everything, but with a two weeks time frame, he has no choice but to send what he has now, with the hope, that's all they need. Regardless, it will give him more time and more importantly, avoid a dismissal of his application. Good luck!!
