  • Non-immigrant visa for spouse of US citizen?

    If the husband just received U.S. citizenship and the spouse living in the home country only wants to visit him once or so every year, what are her options? She doesn't need a green card as that would require her to stay 6 out of 12 months every year to maintain GC status.

    Past story: The spouse's visitor visa application while the husband was a GC holder were already rejected twice and she was asked to apply for an immigrant visa in the past. The husband had made a mistake of not applying for her GC simultaneously when filing his GC application. But now the husband is a U.S. citizen but the spouse doesn't wish to settle in the U.S.

      It's very hard to obtain a non immigrant visa when your spouse is in the US. Most likely she would be denied again and again.
      The most probable solution is just apply for her Green Card. if she doesn't want to live there still she can keep it for a while.
      She can visit once a year and keep the GC active. there's no need to live 6 months a year.
      Then you should decide and live together at one country I guess.

        Do you know what is the EXACT requirement to keep the GC active? And if by chance, she doesn't want the GC but still wants to visit the US, she can't? I mean that's ridiculous.

          If she visits every year and stays a reasonable amount it would be fine for a while.
          Also she can get reentry permit and extend 2 years of peace of mind.
          If she has a spouse in the US, this is a very valid reason so they would not cancel her GC easy.

            Sorry, but what exactly is a reentry permit? Are you saying she can't get a normal visitor visa for 10 years?
