  • Naturalization N400 application while not physically present in the US

So I am eligible to file for naturalization on July 22 2016. But I am taking a summer vacation from June 14 2016 til September 2016 (the date is still undecided)

I would like to still submit my N-400 on July 22 2016, but my question is whether i would be able to. In the section where I have to mention my time abroad, so

    1) should I leave the last trip out of the N400 (since I did not really book a return ticket yet)?
    2) should I make a return flight now and put it in the N400
    3) should I wait until I come back to file

Note: I will leave the country (June 14 2016) this is BEFORE I am eligible to apply for naturalization (on July 22 2016)

    4) If I apply in July 22, without mentioning the last trip, will that be an offence? or
    5) would I just get checklisted and will have to submit more evidence?

I am so confused on what to do. Please let me know in your opinion, what seems like the better of the alternatives.
    please help!!!!!

If you read the N-400 instructions, it clearly states that you have to be a resident for at least 3 months in the State where you are filing from. I assume that means, you have to be physically present in the USA, in that state, at the time of filing (there are exceptions if you are in the Army, Navy etc..).

Customs and Border protection agency is part of the USCIS and they have all the dates of your travel outside of the US. So, there's no question of you doing any sort of cover-up with the dates on your N-400, hoping that USCIS will NOT find out about it, because they have access to that data readily available to them.

In your particular situation, since you plan to travel before your 7/22 eligibility date, the right thing will be for you to file N-400, 3 months AFTER your return date in Sep, since you have to be resident for at least 3 months in that state where you are filing from.
