  • Question about applying for US Citizenship - Parents

    Hi

My parent's got their green card in Oct 2011 and are now planning on applying for their US citizenship. They are approaching their 5 year anniversary. They have met all the conditions for citizenship application including not leaving the US for more than 6 months in any given year. I needed clarification on the following:

1/ We were informed that they can apply for US citizenship 3 months before the anniversary date. That would be around August timeframe. Is there an issue with that or do they need to hit the 5 year mark and only then apply?

You may file Form N-400 ninety (90) calendar days before you complete your permanent residence requirement if your eligibility for naturalization is based upon being a: Permanent resident for at least 5 years; or. Permanent resident for at least 3 years if you are married to a US citizen.

Here is a link explaining Early Filing - https://www.uscis.gov/us-visa-and-im...ing-calculator

They met someone yesterday who said that their early filing got rejected and because of that they lost the application fee and had to re-apply all over again. Please let me know what the correct procedure and timing for application should be?

    Thanks for your help!

Yes they can apply for citizenship up to 90 days earlier than their 5th year GC anniverssary.
May be those persons who said their application got denied applied for citizenship 3 months earlier not 90 days earlier.
Like if you parents 5th year GC anniversary is Oct 11, 2016, they can file for citizenship starting July 13, 2016 (90 days early) not on July 11 or 12, 2016 (3 months early). May be they used 3 months early date which is wrong. So tell your parents apply for citizenship without any doubt.
