  • Am I Eligible?

    I've heard different feedbacks from different people and articles. Different posts and topics. I've consulted with an immigration lawyer twice and he's said both times I'm eligible and should apply for citizenship now. What I've read online says otherwise. Please save me another visit to a different lawyer and some $$. Here is my story, please help me out.

    Greencard holder since before 2000. ( don't ask how I've kept it or what, let's just focus on the past 5 years )

    Time In & Out of the US

    July 2011 to September 2011 ( 3 Months in )
    September 2011 to July 2013 ( Out of US, almost 2 years, Had re-entry permit )
    July 2013 to December 2013 ( 6 Months in )
    December 2013 to January 2014 ( Out of US 1 month )
    February 2014 to October 2014 ( 9 months in )
    October 2014 - October 2014 ( Out of US 2 weeks )
    October 2014 - June 2015 ( 9 Months in )
    June 2015 - June 2015 ( Out of US 2 weeks )
    June 2015 - Current ( 13 Months in )


    Post Re-entry permit, since returning on July of 2013, I've had a total of 37 Months back in the US.

    3 Main questions.

    #1 - Am I Eligible ? If Yes Why? If no Why?

    #2 - Taxes, I've only filed for tax for the years 2013 - 2016. for the years 2011 and 2012, what do I do?

    #3 - How important is this next election? ( Relevant but not relevant, feel free to skip this one )

      I've read that and from what I understand, I am not eligible. If that is the case, why does my immigration lawyer keep insisting that I am? Can you explain it to me?

        You are definitely not eligible for applying for citizenship now. Lets say you have returned to US on July 20, 2013 after your over a year trip, you can apply for citizenship only from July 21, 2017.

          From 2011 you state you were out of the US for almost 2 years! How did you manage to keep your permanent resident status? By all rights CBP should have made you surrender your green card if you entered by "LEGAL INSPECTION".

            Did the lawyer.. whom you admittedly paid consultation fees, not explain why they insist you are eligible? I mean, hope you got your money's worth.

              Hes a highly recommended lawyer. Has his own firm. He said because i have 30 months of residence from my return in 2013, he said that i am eligible. He did not mention the continous residence portion though where i would need 4 years not broken... Is there no way?

                30 months is the physical residency requirement which is good but you broke the continuous residency requirement. Once you stay out of US for more than a year, then once you reenter US, you can apply for citizenship 4 years and 1 day after your reentry date. You can still make short trips out of US within that 4 years and 1 day, that's why your other travels after July 2013 will not hamper your citizenship.

                Your lawyer is definitely wrong. I would not suggest applying for now and lose over 600 dollars for no reason.

                    hi - you are now continuously in the US since 7/2013 - which means you're here for 4 yrs. Plus the "1-yr rule" adds another year. in fact, you were eligible 3 months ago since you can apply at the 5yr mark minus 90days.

                      More Lawyer will be reacted similarly to your case. Ultimate mind of them is to earn revenue from people so they were doing this incidentally.

                      Don`t get confused. You are not eligible for Citizenship, you must wait for 5-year legal residence not 3-year.

                      Be patient until and later definitely you will eligible to apply for Citizenship.

                        You might need to check your mathematics. 4 years from 7/2013 is 7/2017, so how is your statement "you are now continuously in the US since 7/2013 - which means you're here for 4 yrs" true?
                        The user is not eligible for citizenship now. He/she can apply for citizenship only after 7/2017 (4 years and 1 day after his entry date on 7/2013).
