  • Do i qualift for N-400

My situation is i came to US on September 2013 and i stay in US about 10 months. On August 2014 my family in my country have problem so i come back there and stay about 9 months with a re-entrey permit. I come back US on May 2015 and stay in US till now so this september 2016 is gonna be my 3 years to apply for n-400 because i came here as a spouse of US citizen.I heard that we on need to stay 50% of 3 years in US. So i would to know if they still count my 10 months i stay before i went to my country in those 50%. I heard that if we leave US more than six months they won't count time that we live before.

    Hi Phuoc Duong

You have lived in the U.S. lawfully as a permanent resident for at least three years and you are a spouse of a U.S. citizen

During those three years, you have been physically present in the U.S. for at least half of the time.

You have not spent more than one year at a time outside the U.S.

The above statement is true to your consideration then you are eligible to apply for U.S. Citizenship.

    All the best!!

    Regards

    Rachael Leona
