I-751 RFE for arrest record - Charges never filed

Hello,

I was arrested in Oct 2015, charges were never filed and the case was never taken to the DA's office.
- We filed I-751 in January 2016. Receipt notice and extension received promptly
- Biometrics appointment was in August 2016 (6 month delay from filing)
- Received RFE last week.

RFE says - Our records indicate that you were arrested, please provide final court disposition documents.

Since the case was never filed, there are no records that are present in the court or in the prosecutors office. How do we proceed?

How do you know that your case wasn't file?, because if that the case you need to go to the authority who said so and request a documents that stated that charges were not file against you, ANY agency who told you that you were ok, is the one who should issue the doc. because otherwise you will delay your case or possible cancel the application if you do not respond on the time frame of your RFE. Make sure too that you write them an well explain letter of what really happen and attach it to the other letter . Good luck
