  • leaving the country while waiting for naturalization

    My wife's application has been accepted and bio metrics have already been taken. we are waiting for the next step which i am assuming is ceremony or the test? at any rate her grandmother is in poor health and she wants to spend a few months in her home country with them. She has spent a total of two months out of the country in differnet places this year for vacation and just traveling back home. Anyone see an issue with this?

    The rule of thumb is that you don't leave the US soil longer than six months. But frequent traveling can be read as intending to abandon US residence even though each trip is shorter than six months.

    What I would do is the following

    1. Maintain a US address;
    2. Always declare yourself as a US resident when entering the US;
    3. Keep your US credit cards and IDs
    4. Maintain as many ties as possible.
    5. Don't just come back 5 months+29 days. Come back every month or two and stay for a few days or a week before leaving. Show the USCIS that you treasure your US green card and that you do not intend to abandon it.
