  • Regading Citizenship for US born baby for Alien Parents ( L1 Visa ).

    Dear Sir,

    I am currently on L1 Blanket-Visa.I came to US on January 2005. My visa has expired on May 2005 but i have a valid I-94 till January 2008. My spouse is on L2 Visa. She joined me in US on December 2005 and her Visa expires on July 2006. Her I-94 expires on January 2008.

    We are expecting a baby now. The baby is due on October 2006.

    If our baby is born in US will he/she be a US Citizen by birth ?

    Is there any law change which indicates that if the visa status of parents are as like ours then our baby would not be a US citizen even
    he/she is born here.

    I heard that there is bill named "Citizenship Reform Act of 2005" introduced on Feb , 19 2005 which states that :-

    "To amend the Immigration and Nationality Act to deny citizenship at birth to children born in the United States of parents who are not citizens or permanent resident aliens."

    Please help us in clearing this matter.

    As per our current law, all babies born in US are US citizen by birth (except the babies born to Diplomats.)

      Indina parent's legal status in case of US Born Baby

      Myself and my wife are both Indian citizen in USA on L1 / L2 visa...
      We recently had a baby born in USA. My baby is a US citizen by birth.

      I have heard that if the baby is born in US then Indian parent can stay in US on 'some' legal status to take care of the baby...

      Is this correct ?
