  • Baby Born in Canada to US Citizen

    Hello,

    I Came to US in 2000 and now i am US Citizen from End of 2009. However I have moved to Canada in 2013 Visitor Visa and Still living in Canada. I have received the Canadian PR Card also. My Wife is a Canadian Citizen and She also has the Permanent Resident Card of US. We have given birth to baby in October 2016 in Canada. Can you please let me know if my child can get the US Citizenship or not? As I have not stayed in US for 5 years as a US Citizen. If not what is the other way to get Child US Citizenship.

    I can't say concretely as i'm not a lawyer, but the i think the law you're referring to (about living abroad as a naturalized citizen) was removed in 1994

    y'all should take the baby to the US consulate to be declared, bring your proof of citizenship and see what happens

      It's 5 years of being physically present in the US in any status -- whether US citizen, permanent resident, non immigrant, or illegal immigrant. The fact that you naturalized in the US means you had to have been present in the US for many years. So you pretty much certainly have way more than 5 years in the US total.

        Generally speaking... Once a US citizen always a US citizen... and in most cases a child born to a US citizen is automatically a US citizen.
        Just my opinion... Use at your own risk...

          In most cases = only under certain conditions. The OP is trying to figure out whether the child is a US citizen or not. We are saying the child is.
