    Hello Everyone, I got my green card on 06/18/2010 and below are my travel dates:

    India - 08/16/10 - 06/06/11 (293 days)
    Canada - 06/17/11 - 06/25/11 (8 days)
    India - 08/06/11 - 09/12/12 (403 days)
    Canada - 09/15/12 - 09/25/12 (10 days)
    India - 10/31/12 - 05/28/13 - (209 days)
    Canada - 09/04/14 - 09/09/14 - (5 days)
    Dubai-India - 02/01/15 - 03/02/15 - (28 days)
    Canada-England-Europe - 06/19/16 - 07/12/16 (23 days)

    I took my re-entry permit from 09/27/2011 - 09/26/2013

    Based on these dates, when do you guys think I will be eligible to apply for citizenship?
    I am a little confused with the re-entry permit rule of 4 years and 1 day.

    Your citizenship eligibility date depends on whether you are married to a US citizen, and for how long.

      I got my greencard thru family based visa, so I am under the 5 year rule.

        I understand how you got your Green Card. But are you married to a U.S. citizen.

          Sorry for the confusion. When I initially got my greencard in June 2010, other members of my family - my wife and my son also got their green cards. Since both of them stayed in the US for 5 straight years, they got naturalized in 2015-16. So yes my wife is now a US citizen, but my green card is thru the family based greencard category F4.

            It doesn't matter who petitioned you as an immigrant. You are eligible to apply for Naturalization 2 years and 9 months from the marriage date if your wife has been a U.S. citizen the entire period. Since your wife has only been a citizen since 2015 or 2016, you may try to calculate your Naturalization eiigibility based on the 5-year rule. I can't calculate the "4 years and one month" time frame for you since you have almost spent more than the allowable 2 years and 6 months outside of the U.S. in the last 5 years.

            The time periods you have been outside the U.S. are clear breaks in your required "5 years of continuous residency." Any decision by the interviewer to not penalize you for being outside the U.S. for a full year and more or 2-1/2 year aggregate (almost in your case) will be discretionary.

            At the very least, you will be eligible to apply at 2 years and 9 months from when your wife became a citizen, if you have been married to her since then.
