  • Father to become citizen soon. IndianGovt needs affidavit to apply passport for child

    As per Indian passport law, if one of the parents is not present in India then father(or mother) has to apply for Affidavit and get it notarized only and only by the Indian embassy.

    Here is the issue. I still hold Indian passport so I can get an Affidavit notarized by showing my Indian passport to Indian Embassy. Bigger question is, what happens if child does not receive Affidavit before I become citizen. Even if child receives it and applies for passport, what happened to the passport? Will it become invalid?

    What are my options? Is there any other way to bring India born kid to USA after Father has become naturalized citizen? I think Child needs Indian passport as Father was not the US citizen when child was born.

    Your help will be appreciated.

    I don't have an answer to your question.
    but if i understand you, your child is in india and needs a passport which requires you to provide an Affidavit of some sort.
    if you go to the embassy before you become a US citizen, the notary stamp is all that's needed to validate the affidavit.
    As for your question about the child entering the US with an indian passport, i don't know if there are any pros or cons for someone who can clearly obtain a US passport (once you're a citizen) to not do so.

      Thanks for answering my question. My real worry is about the status of the Affidavit. By the time child receives the Affidavit most likely I have already become US Citizen. I am no longer Indian citizen. Affidavit is from an Indian parent who is not in India. If the person no longer remain Indian, does not affidavit considered void?

        Very valid question, i think it's time to call the embassy and ask them, hopefully you land on someone willing to find the answer you seek
