  • On Behalf Of My Partner

    Hello,

My partner and I have been together for almost 5 years now, I live in the United Kingdom, and fly out to the States as often as I can to be with her.
She was brought to the states as a child by her parents from Bolivia, who decided to make a life for themselves, undocumented.

She is now 20 and we're struggling to plan our future together due to her immigration situation, I'm worried that our dreams of settling down together in America is just a pipe dream and will never come to fruition. I know how difficult it is for Illegal Immigrants to make changes to their status, and we're both just lost at the moment and can't see a way forward.

She currently has a legal drivers permit, and permission to work (She works for the government, at a department of children and families), I think it had something to do with DACA that she was able to get all these privileges, but it also means she's ''On the grid'' and they're of aware of her status (or lack thereof), so we're constantly worried she would be easy to deport because they know where she is.

Her parents are both undocumented and working under other peoples names, their other 2 children (Ages 3 and 8) were both born in the US, so I believe they are safe.
Her grandparents maintain permanent residency because their daughter (My partners Aunt) married a US citizen and was able to get them their residency.

I hoped there would be a path she could take to become legal, I feel it would be then easier for me to remain in the country permanently too, rather seeing each other only when my career allows. Our other two options seem to be; for her to seek residency in the UK with me, but that would mean never seeing her family again and waiting 5 years in Bolivia; a country she hasn't been to since she was 2 years old, for everything to be processed. Or, we both uproot our entire lives and move to an Alien country that we don't want to live in.

I apologise in advance for any Forum ''faux pas'' I may have committed, or if I've left out important details, this is my first forum post and am not really sure what I'm doing, we just need help.

    Thank you,

    Alex

Assuming you are not a US citizen, I don't see any path for her to become a permanent resident in the near future, based on the law right now. It's unlikely she will be deported; there is a lot of political support for giving some kind of temporary protection to DACA beneficiaries until an immigration reform bill can be enacted. However, her not being deported doesn't help you to immigrate -- she would need to become a permanent resident or citizen to petition you to immigrate, and who knows if or when that will happen (even if some kind of immigration reform is passed, which is doubtful). If you could somehow immigrate on some other basis not dependent on her (e.g. employment-based), that would be the best option, and it may potentially even help her status too.

This is my personal opinion and is not to be construed as legal advice.

I think you already have the answers to whatever question you are asking. Your partner does not have a "petitionable" relationship with you, so she can't use any U.S. immigration option to help you obtain legal status in the U.S.
