  • Green Card/ US Citizenship Steps Once Married

    Quick Question.

Looking for the steps to have my girlfriend become get Green Card/Citizenship. Here are the parameters.

I am a Natural Born US Citizen. She is from Mexico and her on a temporary resident status. She has been in the US for 18 years on a temporary resident status. If we were to get married, what are the steps of her getting her green card/citizenship. What hula hoops do we have to go through and what is the time table of the Green Card and the time to become US Citizen.

When you saythat your girlfriend is on "temporary resident status," what exactly do you mean? If she entered the U.S. without a visa, she may have to be processed for a spousal visa back in Mexico, and you may also have to submit form I-601A, to obtain a waiver from unlawful presence. Before doing anything however, find out first exactly what her current status is, and what options are available with that status.

She is here on a Temporary Visa. She has to renew it every 2 years. She has been living here on the Temporary Visa. Her and her family came over to the US Legally along time ago. Just on a Temporary Visa

I believe that her Temporary Resident Visa would enable her to remain in the U.S. during processing of her conversion to Permanent Resident status after marriage to a U.S. citizen, since her original entry to the U.S. was a legal entry.

What classification of "visa" is this?

This is my personal opinion and is not to be construed as legal advice.

There is no Temporary Resident visa. It was a status that is no longer available for application. Canada has a Remporary Resident Visa, but an entirely different animal.

Right, the only "temporary residents" are those that were legalized under the 1986 amnesty. But those people were eligible to adjust to permanent resident status. So I doubt that's what the OP is talking about.
