  • US citizenship certificate for a daughter over 18

    Hi all
Can someone claim a US passport or certificate of citizenship for his Daughter who was under 18 years old when her Father became a US citizen ?
If yes what are the steps .
    Thanks

Yes, if she is under 18, a legal permanent resident in the US, she will automatically become a US citizen. You can apply for a passport book for her with your Certificate of Naturalization. Also apply for a passport card for her as a back-up document.

Please find more information and procedure to apply citizenship for your daughter,
This is not a legal advice. Use at your own risk.

Thanks for responding . But my Question is the Daughter now over 30 years old , But she was under 18 when her dad became a US citizen
      An easy way
      Daughter birthdate may 1985
Her father became US citizen July 1994
She came to the US in 1995 . I think they changed the law in 2001 for people who's under 18 with US citizen parent to be automatically a US. Citizen . I hop you understand my question

Her being over 30 now still means she could have been under 18 in 2001. As long as she was a US permanent resident under 18 living in the US with a US citizen parent on or before February 27, 2001, she automatically became a citizen if she wasn't already one. You didn't provide enough information to tell if that was the case.

Prior to 2001, the law required that both parents had to have naturalized (while the child was a permanent resident under 18) in order for the child to automatically get citizenship. So if she turned 18 before February 27, 2001, both parents must have naturalized, or if the parents were divorced or one parent died, the parent having sole custody must have naturalized before the child turned 18.

If the daughter automatically became a US citizen according to the law at the time, then like jnk said, she can just apply for a US passport at any time. No need to apply for a certificate unless she really likes wasting money (it costs $1170).

This is my personal opinion and is not to be construed as legal advice.
