    Hello everyone!

    A little background for my husband, who we just submitted his N-400 a few days ago. He is currently 35 years old, and has been in the United States & a LPR since 1989. He's been married to me (U.S. Born Citizen) for 4 years. We have a few issues, and I've been reading some contradicting information so I was just wondering if anyone could please shed some light?

    1) Selective Services - He did not register for selective services, and genuinely wasn't aware that he had to until we were doing filling out his N-400. I was able to request a letter from SS, and they confirmed that he did not register, however since he's way over 26, the denial of benefits will be in the discretion of the agency. I've read online that as long as he applies after age 31, then he shouldn't have any issues. However, the gal who help us submit our application said to be careful and that people are denied even after age 31. We can't provide much proof, other than telling the IO that he didn't know he had to.

    2) Arrest - When he was 22yo (2004), he was arrested for felony charges of conspiracy to illegally sell sturgeon, unlawful sale of sport- caught fish and unlawful use of multiple rods (LOL, yes for fishing..) He was incarcerated for 1 day, then bailed out. Ultimately, he had to pay fines, and nothing after that. No probation. I requested a letter from the arresting county, and they sent back a document indicating "No Records Found" which means that it was either dismissed or cleared since it was over 13 years ago. We still indicated it in the application, and also sent a copy of the criminal request. Has anyone been denied citizenship for something like this?

    3) Taxes - He's a small business owner, and we are in the process of filing our taxes for 2016. Our tax preparer says most likely he's going to be owing around $40,000 in taxes which we intend on making installment payments for. I saw that a reason for denial was for taxes. But I noticed it's only for those who owe BACK taxes, if we are current and can provide documentations, that should be sufficient, right?


    I'm so sorry if I happen to be answering my own questions, but I'm just really worried. It took a lot of effort for me to finally get my husband to apply for naturalization (he's afraid of failing the test) so I really want to make sure we have all our ducks in a row.     Whatever you do, do not lie to an immigrant officer.
    If it is later found that he lied, the citizenship can be taken away and denied for the future.
    Your husband's situation is complicated. I would go to seek the advice of an immigration attorney.

    Taxes...jail....selective service....all three of these concerns "add up."
