N400 with expired Green Card

  • N400 with expired Green Card

    Hello,

    GC expired 11/2016. Filed for citizenship 5/5/17, in hopes to skip the GC renewal fee.

    My situation is non-complicated & linear.

    I received notification for biometrics, scheduled 5/28/17. They state I need to come with my GC (duh!).

    Note, although not sure it helps my case, but worth mentioning: I do have a valid Global Entry card. (https://www.cbp.gov/trip-cancellatio...s/global-entry). had absolutely zero issues to obtain it.

    From link above: "All applicants undergo a rigorous background check and in-person interview before enrollment."

    Now I am having second thoughts, if I should file for a GC renewal.

    Questions:

    1. will I be denied biometric services if my card is expired?
    2. will there be any problems - strictly from USCIS' point of view (re: my naturalization)?

    No problem is my answer to both questions.
    Any doubt, you Google...."Applying with an expired green card" and you'll get tons of answers from attorneys and even from USCIS.

    But don't misunderstand me. You must go to any appointment with your Green Card!!!!!

        I am in a similar boat but mine is expiring in a month and I applied in January. People said I will be fine but can't make any travel plans - so don't go to Canada or Mexico or anywhere in the world because you won't be able to get in.

        But I just got a notification, letting me know that they have scheduled me an interview so it's more likely within this month!

          Just read your thread before accessing mine :-)

          Thank you for your input! I know about the rule of no travel. I do not have any plans to travel abroad for the time being and I hope nothing unexpected happens to the family overseas. Hopefully, time will pass quickly and uneventfully. Certainly, a good lesson to tell kids about procrastination. Ugh.

          Also, congratulations for your good news & good luck with the interview!

            USCIS recommends applying for a new green card if your current card is expired or will expire in the next 6 months. If you apply for citizenship more than 6 months before your green card expires, you probably will not have to renew your green card.

              I filed in November 2016, GC will expire in August 2017. I just had my interview last week and I asked the officer at the interview about this issue, she insisted one need to apply for GC.

                Spoke with the officer today at my interview . said we have to make an appointment via InfoPass and they will stamp on your passport? or someting. Bring your passport, your expired Green Card, and a form saying that you have passed the citizenship, they will make sure you are able to get back in.

                I plan to make an appointment via InfoPass so I can get it stamped just in case if I didn't have the Oath ceremony in time.

                  Saw your question and googled it. Here is what I found out from a law firm.

                  In the past, USCIS and some immigration attorneys believed that you could not become a naturalized citizen if you did not have a valid green card (LPR) card to bring with you to your naturalization interview. This is in error. USCIS will allow someone with an expired or lost green card to naturalize and become a U.S. citizen.

                  So save yourself the time and expense associated with filing the I-90 to get a replacement green card. If you are eligible for naturalization, this issue will not derail your application.
