  • couldn't find ex after 3 years separation .

    I and my ex are refugees from Malaysia. We both came to US in August, 2011. We both have green card 1 year after we arrived.

    In January, 2014, we separated and do not live together anymore. We didn't have any legal documents for separation or divorce. Since then I don't have any contact with him. But I heard that he left

    US and living in Thailand. He already married another woman. Now I am the one who is still living in US and need to apply citizenship.

    in N-400 application, there is a question that " what is your current marital status". I answer separated and he is a LPR. But when I collect all the documents to submit

    N-400, I need to proof the legal separation paper. I don't have NONE. I have been holding to submit and I have no idea how to get that paper. He is outside of US and married.

    How can I apply citizenship? This is not a marriage fraud because he is not an American Citizen. Pls help me.

    If you've been married before, why would your answer to that question be anything other than "yes"?

      The problem is i don't have any legal separation paper to proof that I am separated with him more than 3 years.

        If you got married, and since then have not gotten legally separated or divorced, then your marital status is "married"

          Am I going to be OK ,if I answered separated and explain what happened to the Immigration Officer ?

          My situation is very complicated. I don't have any proof of legal separation even after 3 years later. And then, He is not

          here anymore and married.

            You're married but estranged from your spouse

            Your situation is neither complicated nor uncommon

            In fact, if you wanted to get divorced, there is a procedure ("by publication") that addresses this specific situation
