  • Eligibility for N400 if traveling abroad 10 months!

    Hi everyone,

I just want to hear your opinion and if anyone else finds himself in the same situation.
I am permanent resident since Nov. 2013 and I received my GC through my husband which is a US citizen.
I am thinking of applying for Citizenship in June 2017, since I will meet both the requirements ( physical presence and continuous residence) then.
The problem is that I took two long trips to my home country, one that lasted 10 months and one that lasted 6 months and other two that lasted a few weeks. I had a very serious reason because my grandmother had a long lasting sickness which actually resulted in her death. ( I have a death certificate as proof)

Also, I took a re-entry permit before my departure and maintained a lot of ties with the US (my husband remained in the US, yearly taxes, we maintained our home for the entire period).

We took an appointment with USCIS but the officer there told us that he is not specialized in N400 and he can give us an advice as per his own experience and common sense. We also consulted a lawyer that is very positive and confident about the fact that I should apply and that we have a lot of proof to get it.

What are your thoughts and experiences about this ? would I be eligible to apply?

Any help would be highly appreciated! Thank you!
