  • Can I get married 2nd time out of my state?

    I am a happily married person. I love my wife and I vowed to stay with her all my life. She is the reason I am a good & happy person today with moral values. I came to the USA in 2007 through Student Visa. At that time I had some personal & mental issues and no-one was here to support me. But, my wife did.(that time girlfriend and came to the USA on F1 Visa). It's a long story. Anyway, I lost my status in 2012, as well my wife just last year. I am in a situation where I am out of options to settle my status in the USA. I love this country & really wish I can settle my status legally. I can not write down every single detail here as it has so many personal details.

    I consulted a lawyer last year, and he told me I have one and only option to settle my status in the USA, which is getting married to a US Citizen. Since I am married to my wife and don't want to give divorce to my wife. I don't know what option is left for me.

    Recently, I read a similar case, where a guy got married to another woman outside his state to a US Citizen to settle his status. Is this Legal to get married 2nd time in the USA? If so, will it settle my status in the USA?

    No this is fraud. No "settlement of status" is worth the ensuing hassles.
    Just an opinion; Not legal advice.

      Don't ever think about it, if you do that you could be banned for life for any immigration benefit. Is better to try other options like obtaining a work visa, and to answer your question is not legal some people do that but is because they commited fraud lying to the court about marital status.

        Definitely fraud, also, USA does not recognize polygamous relationship - hence no one can get any immigration benefit out of such relationship. (USA will recognize the 1st spouse to be the one and only spouse).

        And you will fail to prove the marriage is entered in good faith (bonafide relationship)

          Absent a finalized divorce, a 2nd marriage is not legal, and is not effective for immigration purposes (if done abroad in jurisdictions that permit it)
