  • Arriving to usa with 2 kids with IR2

    Hi
I am arriving to the usa with my two kids each has IR2 visa . What is the process next? What is the procedure until they receive the US passports ? I have no idea what will happen after we are admitted in the airport..
    Thank you

Your next step is to pay the $220 Green Card fees for each. Soon as either parent is naturalized, the children, if under age 18, will be U.S. citizens and can apply for U.S> passports.

You can pay the $220 each for Green Cards soon as they have visas, or after they arrive in U.S.
If they are under age 18, there is no N-400 requirement for their citrizenship. You will be able to apply for their U.S. passports after they are in the U.S., based on their derived citizenship from your Naturalization.

I don't think it's necessary to pay the $220 immigrant fee. They might not send you the plastic green card if you don't pay the fee, but by law they are already US citizens the moment the enter the US (and living in the US with a US citizen parent). They already have the immigrant visa stamped upon entry which serves as an I-551 (proof of permanent residency), and with that, they can apply for a US passport. It doesn't matter if they never get a plastic green card.

This is my personal opinion and is not to be construed as legal advice.
