  • Name Change During the Interview

    My wife has requested name change during the interview. She passed the test and the officer has taken a request with her signature (with old name) to change her name and told my wife that we will receive a letter to go to the court for name change and then come back for oath. Does this mean that the petition has been filed for name change> ?
    .
    When i talked my lawyer we were told that we need to file a petition to the court again. Do we have to do that again?
    .
    How long does this process take? How long does it take after the court process?
    .
    Do we have to file a petition again through the lawyer?.
    .
    Any help would be greatly appreciated.

    Why can't name change be taken as a separate process after getting the citizenship? Already the immigration is such a wait and cross-my-finger process, why would anyone want to complicate the things? Don't mistake me. I am just curious...

      Raj,

      I was told during the interview that USCIS doesn't process name change requests. They advised me to go through court. Talk to your lawyer regarding the process. Not sure how long does the name change process takes.

        Thank You all for the information. We are sending the petition to the court so that we will have court approval. That way we will not waste any time.

          The interview date for my wife and I is scheduled for 12/13/2006 at the Fairfax, VA DO. On my wife's application, we had put in a name change to switch to my last name.

          I will be interested in knowing if this will delay the process. If we find out that it will, we will probably not go in for the name change during the interview.

            check with lawyer may be. See if you can send a petition to the court and hvae the petition approved before you go for interview. what i was told is just finish of the interview and take oath let the old name be there and then send a petition for name change it only takes 2-3 weeks.

            I did not find/enquire all that before my wife went interview now she did not take oath though she is cleared the interview.

              Don't worry at all - This did not change anything for me - it was very simple.
              Although I am trying to update my last name in all the diff agencies now but not sure if I cover everything - has anyone done this , If so- can I get some guidance...
